Financial Obligations

ANNUAL DAM-RELATED EXPENSE TO UMLCC - These property owners:

Are obligated each year, to make payments to the UMLCC toward the agreed-upon dam-related expenses as listed below:

Liability insurance premiums for the dam only

One-half of UMLCC D&O insurance premiums
-
All inspections required by law
-
Legally required maintenance and repair of the dam

Taxes on the dam

Professional fees directly related to the dam upkeep

Are obligated to pay $350 or 3.6% of dam-related expenses in 2021 and subsequent years until DEP dam loan special assessment percentage sd have been determined.

Are obligated to pay amended annual dam-related expense amount once the Township loan assessment percentages are final, including any appeals. At his time the percentage of the agreed upon dam related expenses will be in accordance with the proportionate share established by Evesham Township for the repayment of the dam loan and the 3.6% previously paid shall no longer apply (see 2021 Agreement & Release, page 6, paragraph 1).

Are subject to collection actions for failure to submit annual dam-related expense payments; Collection actions include the payment of late fees, collection costs, reasonable attorney's fees, and the filing of lien claims as applicable by law.

Are responsible for payments in arrears for years 2018, 2019, and 2020 in the amount of $200 per year

Payments for years 2018, 2019, and 2020 shall be made to UMLCC in no more than 3 installments on dates listed below. Payments made thereafter will be subject to late payment charges and costs of collection as set forth above. (These dates have been extended from those identified in 2021 Agreement & Release to allow time due to the agreement finalization being delayed. Please do not hesitate to contact Leslie Walker if these dates are not acceptable.

Judgment shall be entered and recorded by UMLCC against plaintiff property owners who shall thereby be responsible for paying their annual dam-related expenses and any payments in-arrears (back to 2018) to UMLCC, which shall act as a lien.

Becoming a UMLCC Member

These property owners may choose to become members of UMLCC on a year-to-year basis provided that they make a written commitment to do so by December 1 of the previous year.

This written commitment must be accompanied by a $350 deposit which will become part of their annual dues payment

The balance of the membership dues will then be due by April 1 in congruence with all other member expectations.

Additional income from new members contributes to annual budgetary planning, therefore, this December 1 commitment must be adhered to. Failure to follow through with membership commitment will be subject to collection actions. Collection actions include the payment of late fees, collection costs, reasonable attorney's fees, and the filing of lien claims permitted under the UMLCC By-laws, Rules and Regulations and as applicable by law.
